Lasting Power of Attorney

What is a Lasting Power of Attorney?

​

A Lasting Power of Attorney is if you are unable to look after any of your assets you can appoint someone to deal with your financial affairs. This will save you less hassle and the person you have appointed to look after your affairs will handle them correctly.

​

If you were to lose mental capacity without having an LPA then your family has to apply to the Court of Protection so that a deputy can be arranged to be able to deal with your financial affairs. This job is a time-consuming and expensive procedure and costs thousands of pounds.

You can create two kinds of LPA:

  • Health and Welfare LPA
  • Property and Financial Affairs LPA

 

Who can make an LPA?

Anyone over the age of 18 can make an LPA

Disabled and Vulnerable Persons Trust

​

If you are looking after a person who is disabled and not able to manage their financial affairs then you will need to apply for a Disabled & Vulnerable Persons Trust.

​

If the right plan of action is not put in the correct place then the local authority can stop the vulnerable person funding.
